Welcome to Buba AI. These Terms of Service ("Terms") govern your access to and use of our AI coaching service, website, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Eligibility

To use Buba AI, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately.

Account Registration

When you create an account, you agree to:

• Provide true, accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Not share your account with others
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

Use of Service

Permitted Use

You may use Buba AI to:

• Receive business coaching and advice
• Ask questions about building and growing your business
• Access your conversation history
• Use voice and text coaching features

Prohibited Use

You may NOT use Buba AI to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or illegal content
• Attempt to reverse engineer or hack the Service
• Use automated tools to access the Service (bots, scrapers)
• Resell or redistribute the Service without permission
• Impersonate others or provide false information
• Interfere with or disrupt the Service
• Collect user data without consent
• Use the Service for any unlawful purpose

Credits and Payment

Credit System

Buba AI uses a credit-based system:

• Credits are used for text and voice coaching sessions
• Credit costs vary based on usage type and duration
• Credits do not expire
• Credits are non-transferable and non-refundable except as required by law
• Unused credits remain in your account until used or account deletion

Pricing and Purchases

When purchasing credits:

• All prices are in USD unless otherwise stated
• Prices are subject to change with notice
• Payment is processed securely through our payment provider
• You authorize us to charge your payment method
• You're responsible for all applicable taxes

Refunds

We offer refunds under the following conditions:

• Request within 7 days of purchase
• Credits have not been used
• No previous refund requests on your account
• Service issues that prevented usage

Refunds are processed within 5-10 business days to your original payment method.

Intellectual Property

Our Content

The Service, including all content, features, and functionality, is owned by Buba AI and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our Service
• Remove or alter any copyright notices

Your Content

You retain ownership of the content you provide to Buba AI (questions, business information, etc.). By using the Service, you grant us a limited license to:

• Process your content to provide coaching services
• Store your conversations for your access
• Use aggregated, anonymized data to improve our Service

We will not share your specific conversations or business information with third parties without your consent.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results or advice will be accurate, complete, or reliable
• Any errors or defects will be corrected
• The Service will meet your specific requirements

Important: Buba AI provides general business coaching and advice. It is not a substitute for professional legal, financial, or accounting advice. Always consult qualified professionals for specific business decisions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUBA AI SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Business decisions made based on our coaching advice
• Service interruptions or technical issues
• Unauthorized access to your account

Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months before the claim arose, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Buba AI from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

Termination

By You

You may terminate your account at any time through your account settings. Upon termination:

• Your access to the Service will end immediately
• Your data will be deleted according to our Privacy Policy
• Unused credits will be forfeited
• You remain responsible for any outstanding payments

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account has been inactive for an extended period
• We're required to do so by law
• We discontinue the Service

We'll provide notice when reasonably possible, but we reserve the right to terminate immediately for serious violations.

Dispute Resolution

Informal Resolution

If you have a dispute with us, please contact us first to try to resolve it informally. We're committed to working with you to find a fair solution.

Governing Law

These Terms are governed by the laws of the jurisdiction where Buba AI operates, without regard to conflict of law principles.

Arbitration

Any disputes that cannot be resolved informally will be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits or class-wide arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buba AI regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We're not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, or technical failures.

Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We'll update the "Last updated" date
• We'll notify you via email or in-app notification
• We'll give you at least 30 days notice before changes take effect

Your continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree, you must stop using the Service and may delete your account.
